In the recent decision of R&B Investments Pty Ltd (Trustee) v Blue Sky (Reserved Question) (2024), the Full Court of the Federal Court ruled that it has the power to grant Solicitors' Common Fund Orders (CFO). These orders allow Solicitors to take a percentage of the settlement proceeds, in addition to costs and disbursements.
