This seminar will address two common forms of client and opponent communication – Letters of Advice and Letters of Demand.
Failure to comply with the strict legislative guidelines governing these communications may have serious consequences for a practitioner (and may adversely impact on the client’s matter).
Practitioners could also face disciplinary action and/or proceedings for misleading and deceptive conduct being brought against a practitioner personally.
Letters of Advice:
The letter of advice sets the scene for managing client expectations. It must be clear enough to avoid any ambiguity while also protecting you from a potential negligence claim brought by a dissatisfied client.
Letters of Demand:
Learn where practitioners have been going wrong in drafting these important documents and receive tips to protect yourself from unintended claims from your client or third parties!
Our presenter will provide guidance on how to draft proper and effective letters of advice and demand, focusing on structure, content to include and omit, language, and how to tailor it appropriately to the client and situation.
