The Office of the Australian Information Commissioner has new powers following amendments to the Privacy Act 1988 (Cth), and 2026 looms large for organisations that have not prepared for the significant reforms that were implemented.

With the first tranche of Privacy Act reforms now in force, one of the more significant changes introduced a new statutory tort for serious invasions of privacy, and the requirement for practitioners to be prepared and advising their clients on the changes has never been more critical.

This seminar will discuss these issues and more, including:

  • Expanded OAIC powers, new penalty tiers, infringement notices and compliance obligations.
  • The new statutory tort for serious invasion of privacy - What it means for individuals and organisations and applicable damages.
  • Strengthening of Australian Privacy Principle 11.
  • Emerging enforcement trends heading into 2026, including cyber breach litigation, class actions, AI and data scraping.
  • Regulatory priorities for 2026 and beyond.
