A ‘road’ has a wide definition, including bridges, footpaths, public highways and even rights of way. Land which is noted on a title as a ‘road’ usually resides in the original landholder's name, however the land usually has no value since the Local Government Act gives the Council powers to discontinue roads and transfer them into its own name without any payment of compensation.

This seminar will discuss the complex issue of when roads, their discontinuance and claims for adverse possession collide.

The seminar will discuss issues including:

  • Definition, and creation of ‘Roads’ - How to find out if there is a road in the title?
  • What your client can and cannot do with a road on their land.
  • Discontinuance – Who can apply? Timeframes? Compensation?
  • Adverse Possession claims.
  • Obtaining, transferring or exercising the rights of a licence over an unused road
