The security of payments regime in Victoria looks set to implement many of the recommendations made by the Victorian Environment and Planning Standing Committee late last year. The proposed changes would improve the laws governing security of payment for subcontractors and bring Victoria in line with other state jurisdictions.

These proposed changes foreshadow a significant impact on building and construction contractors, subcontractors and suppliers who rely on progress payments under the Building and Construction Industry Security of Payment Act 2002 (Vic).

This session looks at the current state of the security payment laws, particularly considering the longstanding calls for change following the 2017 Murray Review, and considers the impact of Committee’s major recommendations about:

  • Understanding the contract and when a party may breach its payment obligations
  • Failure to make payment, late payments, and short payments
  • A party’s right to suspend work, withhold goods or exercise a lien
  • The adjudication process to resolve payment disputes
  • Claiming interest
