It is not uncommon for an insurer to undertake some sort of surveillance of a plaintiff in personal injury proceedings. However, due to pre-litigation disclosure requirements, there is little room anymore for a courtroom ‘ambush’ of a client being caught out.

This seminar will discuss the key issues surrounding the use of surveillance in personal injury matters, and how footage may be recorded and used in proceedings. The seminar will discuss issues including:

  • Advice to provide clients regarding the use of, or potential use of, personal surveillance.
  •  When surveillance is used, and can surveillance be discounted or excluded from evidence?
  • Pre-litigation disclosure requirements relating to personal surveillance footage.
  • Can privilege be claimed over personal surveillance footage?
  •  Subpoenas for surveillance footage, and costs.
  • Case update.
